Vacation Rental Agreement & House Rules

By booking, occupying, or entering the Property, Guest acknowledges and agrees to the following terms and conditions.

1. DEFINITIONS

"Management" refers to O'Neal Vacation Rentals ("OVR"), its employees, contractors, agents, and representatives.

"Property" refers to the vacation rental home reserved by Guest.

"Guest" refers to the primary renter and all occupants, invitees, visitors, children, and pets (if permitted).

This Agreement is a temporary lodging agreement only and does not create a tenancy, leasehold interest, or any rights in real property.

2. ELIGIBILITY & BOOKING REQUIREMENTS

  • Primary Guest must be at least 25 years of age.
  • The individual making the reservation must occupy the Property during the stay.
  • Government-issued identification will be required.
  • Guest must provide a valid credit card for incidentals and damages.
  • Reservations obtained under false pretenses may be cancelled immediately without refund.

3. OCCUPANCY

Only registered guests may occupy the Property.

Occupancy may not exceed the maximum occupancy stated in the listing, reservation confirmation, or applicable local regulations.

Unauthorized occupants may result in:

  • Immediate termination of occupancy
  • Additional guest fees
  • Fines
  • Removal from the Property without refund

4. QUIET ENJOYMENT / GOOD NEIGHBOR POLICY

Vacation rentals are located in residential neighborhoods.

Guest agrees to respect neighbors at all times.

Quiet Hours:

  • 9:00 PM – 8:00 AM daily

Noise Restrictions:

  • Outdoor music prohibited after 9:00 PM
  • Noise must remain below local ordinance requirements
  • Excessive noise, yelling, amplified sound, musical instruments, animal barking, or disruptive behavior is prohibited

Any verified violation may result in:

  • $500 minimum violation fee
  • Immediate eviction
  • No refund

Guest is responsible for all governmental citations, HOA fines, administrative penalties, security response fees, and costs resulting from violations.

5. NO PARTIES OR EVENTS

Parties, receptions, weddings, celebrations, gatherings, commercial activities, filming, and events are prohibited unless expressly authorized in writing by OVR.

Violation constitutes a material breach of this Agreement and may result in:

  • Immediate removal from the Property
  • Loss of all rental payments
  • Additional fines and damages

Minimum Event Violation Fee: $1,000 plus actual damages.

6. PARKING

Guest shall comply with all posted parking regulations and local ordinances.

Street parking is prohibited where restricted.

Guest is responsible for all parking citations, towing fees, and related expenses.

7. SMOKING POLICY

Smoking, vaping, marijuana use, cigar smoking, and similar activities are prohibited anywhere inside the Property.

Where local ordinances or Property rules prohibit smoking outdoors, Guest must comply.

Minimum Smoking Violation Fee:

$500 – $2,500 plus actual remediation costs, including:

  • Odor removal
  • Deep cleaning
  • Upholstery treatment
  • HVAC cleaning
  • Lost rental revenue

8. PET POLICY

Pets are prohibited unless expressly approved in writing.

Unauthorized pets will result in:

  • Minimum $500 fee
  • Additional cleaning charges
  • Damage charges

Service animals protected by law remain subject to applicable legal requirements.

9. PROPERTY CARE

Guest shall:

  • Keep Property in good condition
  • Use appliances only for intended purposes
  • Report damage immediately
  • Leave Property in substantially the same condition as received

Guest shall not:

  • Rearrange furniture without authorization
  • Remove Property items
  • Tamper with mechanical systems
  • Disable security devices

Charges may be assessed for restoring furniture, replacing missing items, repairing damage, or excessive cleaning.

10. CHECK-IN / CHECK-OUT

  • Guests shall comply with check-in and check-out times provided by OVR.
  • Unauthorized early arrival or late departure may result in a fee of $50 per 30-minute increment or portion thereof.
  • Holdover occupancy is prohibited.
  • Guests who remain beyond checkout may be removed and charged all resulting costs, including lost revenue and relocation expenses for incoming guests.

11. CLEANING REQUIREMENTS

Upon departure, Guest shall:

  • Follow the listed checkout instructions listed for the Property.
  • Secure windows and doors.
  • Leave Property reasonably clean.

Excessive cleaning will result in additional charges.

12. DAMAGE AUTHORIZATION & PAYMENT AUTHORIZATION

Guest authorizes OVR to charge the payment method on file for:

  • Property damage
  • Missing items
  • Unauthorized pets
  • Smoking violations
  • Excess cleaning
  • Unauthorized occupancy
  • Noise violations
  • Event violations
  • Pool heating charges
  • Late checkout
  • Municipal fines passed through to OVR
  • Any costs necessary to restore Property to pre-arrival condition

OVR will provide written notice before processing charges whenever reasonably possible.

Evidence supporting charges may include:

  • Photographs
  • Videos
  • Staff reports
  • Security reports
  • Vendor invoices
  • Repair estimates
  • Neighbor complaints
  • Monitoring system reports

Guest agrees not to initiate a chargeback for valid charges authorized under this Agreement.

13. INSPECTIONS & ACCESS

OVR may enter Property when reasonably necessary for:

  • Emergencies
  • Repairs
  • Safety concerns
  • Rule violations
  • Maintenance
  • Property protection

OVR may also permit access by authorized vendors, including:

  • Pool technicians
  • Pest control
  • Maintenance personnel
  • Utility providers
  • Housekeeping personnel

Reasonable notice will be provided whenever practicable.

14. SURVEILLANCE & NOISE MONITORING

Properties may contain:

  • Exterior security cameras
  • Exterior video monitoring
  • Exterior security systems
  • Noise monitoring devices

No recording devices are located inside living spaces.

Guest consents to the use of these systems for safety, security, and rule enforcement purposes.

Tampering with monitoring equipment constitutes a material violation of this Agreement.

15. INTERNET, CABLE & TECHNOLOGY DISCLAIMER

Internet, Wi-Fi, streaming services, television services, smart home systems, and cellular service are provided as conveniences only.

OVR does not guarantee:

  • Availability
  • Speed
  • Compatibility
  • Continuous operation

No refunds shall be provided for service interruptions.

16. MAINTENANCE & PROPERTY CONDITIONS

Mechanical systems occasionally fail.

This includes but is not limited to:

  • HVAC systems
  • Appliances
  • Hot tubs
  • Pools
  • Internet systems
  • Plumbing
  • Electrical systems

OVR will make commercially reasonable efforts to address reported issues.

No refunds or rent reductions shall be provided for temporary interruptions or failures beyond OVR's reasonable control.

17. POOLS, HOT TUBS & RECREATIONAL AMENITIES

Guest acknowledges that pools, spas, hot tubs, bicycles, surfboards, boogie boards, fireplaces, stairs, decks, barbeques, ocean access, and recreational equipment involve inherent risks.

Guest voluntarily assumes all risks associated with their use.

Children must be supervised by a responsible adult at all times.

Pool and spa temperatures cannot be guaranteed.

Unauthorized adjustments to pool equipment or heating systems may result in additional charges.

18. COASTAL, WILDLIFE & NATURAL HAZARD DISCLOSURE

Guest acknowledges the Property may be located in areas where naturally occurring conditions exist, including:

  • Insects
  • Ants
  • Rodents
  • Wildlife
  • Coastal hazards
  • Rip currents
  • Large waves
  • Cliff erosion
  • Slippery surfaces
  • Uneven terrain

No refunds shall be issued for naturally occurring environmental conditions.

19. FIRE SAFETY

Fireworks are strictly prohibited.

Properties may be located in high fire-risk areas.

Guest agrees to comply with all burn bans, fire restrictions, and emergency orders.

Guest shall be liable for all damages, fines, and costs resulting from violations.

20. FORCE MAJEURE

OVR shall not be liable for circumstances beyond its reasonable control, including:

  • Wildfires
  • Floods
  • Storms
  • Earthquakes
  • Public utility outages
  • Evacuation orders
  • Government restrictions
  • Pandemics
  • Road closures
  • Labor disputes
  • Internet outages
  • Acts of God

Refunds, if any, shall be governed solely by the applicable booking platform or OVR cancellation policy.

21. HOST CANCELLATION

If Property becomes unavailable due to circumstances beyond OVR's control, OVR may:

  • Provide a comparable substitute property; or
  • Refund amounts paid

This shall be Guest's sole remedy.

22. RELEASE OF LIABILITY

To the fullest extent permitted by law, Guest releases and discharges OVR, Property Owner, and their employees, contractors, agents, and representatives from claims arising out of Guest's occupancy and use of the Property.

Guest understands that use of the Property and its amenities involves risks that may result in injury, illness, property damage, or death.

23. INDEMNIFICATION

Guest agrees to defend, indemnify, and hold harmless OVR, Property Owner, and their employees, contractors, agents, and representatives from any claims, damages, liabilities, losses, fines, penalties, costs, and attorney fees arising from:

  • Guest's occupancy
  • Guest's negligence
  • Guest's violation of this Agreement
  • Actions of Guest's invitees or visitors

24. DISPUTE RESOLUTION

Any dispute arising under this Agreement shall be governed by California law.

Venue shall be exclusively located in the county where the Property is located.

The prevailing party shall be entitled to recover reasonable attorney fees and costs.

(OVR may elect to replace this section with a California attorney-drafted arbitration provision.)

25. SEVERABILITY

If any provision of this Agreement is determined unenforceable, the remaining provisions shall remain in full force and effect.

26. LOST & FOUND

OVR is not responsible for lost, stolen, or abandoned property.

If items are located and returned, shipping and handling fees will apply.

Minimum handling fee: $35 plus shipping costs.

27. ENTIRE AGREEMENT

This Agreement, the listing, House Rules, booking platform terms, reservation confirmation, and any written Property-specific rules collectively constitute the entire agreement between Guest and OVR.

By booking, entering, or occupying the Property, Guest acknowledges that they have read, understood, and agree to be bound by all terms of this Agreement.
